AMCHAM Expresses Concern Over “Yellow Envelope Act”
AMCHAM Supports Unified Call from Korea’s Eight Major Business Organizations and
Emphasizes the Importance of a Predictable Business Environment
July 30, 2025 - The American Chamber of Commerce in
Korea (AMCHAM; Chairman and CEO James Kim) expressed concern over the recent
passage of the so-called “Yellow Envelope Act” by the National Assembly’s
Environment and Labor Committee, emphasizing its
potential impact on Korea’s business environment and overall investment
attractiveness. AMCHAM also voiced strong alignment with the joint statement
released by Korea’s eight leading business organizations regarding the
legislation.
The amendment would expand protections
for subcontracted workers, restrict employers’ ability to seek damages from
strike-related disruptions, and broaden legal liability for company executives
who decline to participate in collective bargaining. AMCHAM noted that these
changes could significantly increase legal and operational burdens for global
companies, including U.S. firms operating in Korea.
“A flexible labor environment is
essential to strengthening Korea’s competitiveness as a business hub in the
Asia-Pacific region,” said James Kim, Chairman and CEO of AMCHAM. “If
enacted in its current form, this legislation could influence future investment
decisions by American companies considering Korea.”
He added, “The 2025 APEC Summit presents
a valuable opportunity for Korea to demonstrate leadership in innovation and
economic policy. At this critical juncture, it is important to consider the
broader message this legislation may send to the global business community.”
AMCHAM also noted that the bill has
moved forward without sufficient input from industrial stakeholders, despite
continued concerns from the business community. AMCHAM emphasized that
improving Korea’s labor-management culture through reasonable legal and
institutional reform should be prioritized.
Chairman & CEO Kim further noted, “According to AMCHAM’s
2024 Business Environment Survey, regulatory unpredictability remains one of
the top challenges for foreign-invested companies in Korea. This legislation
may add to that uncertainty and, in turn, undermine Korea’s global
competitiveness.”
AMCHAM reaffirmed its commitment to
close collaboration with government, business, and labor stakeholders to
support the development of policies that promote a predictable, sustainable,
and balanced business environment.

암참은 지난해 해당 법안이 처음 발의되었을 당시에도 반대 입장을 표명한 바 있으며, 당시에도 기업 환경의 불확실성과 규제 리스크에 대한 우려를 강조했었다.
이번 개정안은 하도급 근로자에 대한 보호 범위를 확대하고, 쟁의행위에 따른 손해배상 청구를 제한하는 한편, 단체교섭에 응하지 않은 경영진에 대한 법적 책임을 확대하는 내용을 담고 있다. 암참은 이러한 변화가 한국에 진출한 미국계 기업을 포함해 글로벌 기업 전반에 법적·운영상의 부담을 높일 수 있다고 지적했다.

암참은 또한, 이번 법안이 산업 현장의 우려에도 불구하고 충분한 의견 수렴 없이 추진되었다는 점을 지적하며 절차적 보완이 필요하다는 입장을 밝혔다. 아울러 합리적인 노사문화 정착을 위한 법·제도 개선이 선행되어야 한다고 강조했다.
