“What do the recent Korean Supreme Court decisions really mean in calculating ordinary wage?”



Dear AMCHAM Members,

Last month, the Korean Supreme Court rendered two decisions that greatly expanded the scope in calculating ordinary wage (which, in turn, affects O/T pay, unused vacation pay and eventually statutory severance, if applicable). The Court decisions have created much concern among all employers due to the enormous cost increases that may apply, particularly taking into account the limitations period of 3 years for wage-related claims. While the Supreme Court remanded the cases for further review by the lower courts to be consistent with the Court’s decision, new claims and lawsuits by Unions and employees against their employers in Korea have sharply increased. Two of Korea’s leading labor law experts will help us to really understand the Supreme Court decisions and, more importantly, create a practical approach to ensure we properly comply with the new laws.

Paul Cho is a US licensed attorney and a senior foreign partner in the Labor & Employment practice group at the Seoul based law firm of Lee & Ko. Paul has over 20 years of legal experience in the US and in Korea, and is widely recognized as an expert in Korean labor and employment laws, restructuring, strategic planning, and crisis management.
