"What Privacy Do We Really Have?"

Dear AMCHAM Members,

It has become quite common in Korea to hear of serious personal data and confidential information breaches or leaks through the media and social network sites. These data breach cases occurred in various industries, notably in financial and IT sectors. Many of us no doubt are concerned about the safety of our own data.

As these concerns have increased among the general public, amendments were made recently to the main privacy law in Korea covering Internet data (Promotion of Information Network Use and Information Protection Act) to impose additional obligations on companies that collect and use personal information, including deletion of personal information and statutory damages and monetary penalties for violations, as well as data protection governance. The burden of proof has also shifted from the individual to the service provider.

Doil Son, partner at the Korea based law firm of Yulchon LLC, will provide us with a better understanding of the amendments to the above Act and other key regulations regarding the data protection. He will also share a proactive plan to ensure compliance. As the amendments to the Act will become effective in November 2014, all stakeholders are highly encouraged to attend.
