AMCHAM Calls for Deregulations to Accelerate Korea’s Transformation into Regional Headquarters in Asia AMCHAM Board of Governors offers set of policy recommendations to President-elect Yoon Suk Yeol Transition Committee April 29, 2022 – American Chamber of Commerce in Korea (AMCHAM; Chairman and CEO James Kim) called on President-elect Yoon Suk Yeol to lift regulations to make Korea the best business destination for global companies in Asia. On behalf of the American business community in Korea, the AMCHAM Board of Governors sent a letter to the Transition Committee today to call for reform. The letter details a set of policy recommendations to the incoming presidential administration. The letter contained signatures by 34 members of the AMCHAM Board of Governors. AMCHAM Board members highlighted various items, including the need to improve the flexibility of employment conditions, mitigate CEO risk, restore the flat tax rate for foreign residents and improve the regulatory environment to ensure proactive communication in support of transforming Korea’s position as a regional headquarters in Asia. l Labor Market: Improve the flexibility of employment conditions, including an extension of exemptions from the 52-hour work week restriction. l Executive Risks: Modify much of the strict criminal liability on CEOs which in other advanced economies would be civil in nature, including additional risk recently introduced by the implementation of the Serious Accident Punishment Act (SAPA). l Tax: Restore the flat tax rate for foreign residents and restructure the inheritance tax obligations on foreign residents. l Regulatory Environment: Proactively communicate any potential changes to regulations through advance public consultations so that global firms may provide suggestions in advance. AMCHAM Member Companies Hopeful that New Government will Improve the Business Environment - AMCHAM releases 2022 Business Survey Report - - More than 80% of respondents optimistic that investment in Korea will continue - Korea-unique regulations, CEO risk, strict labor laws, high tax rates selected as key areas in need of improvement April 7, 2022 – On April 7, 2022, AMCHAM Korea released the results of the 2022 Business Survey. The survey, which collected responses from more than 80 member companies between February 24 and March 25, was designed to gather opinions on the business environment in Korea ahead of the inauguration of the new government and provide insight to make Korea a more attractive investment destination. According to the survey, feedback on Korea's overall business environment was mixed without any particular bias. Respondents specifically cited Korea-unique Standards, CEO risk, strict labor laws and high tax rates as key areas for improvement. Regarding COVID-19, 4 out of 10 companies said they did not meet their growth targets last year, reportedly due to COVID-related supply chain problems, uncertain economic conditions, and other relevant issues that hindered sales. More than half of the companies surveyed expressed optimism about Korea's business prospects, while more than 80 percent of the companies surveyed expected investment in Korea to continue over the next two years. In addition, South Korea was selected as the second most preferred destination for regional business headquarters in Asia after Singapore, confirming once again that Korea is an attractive investment destination for multinational companies. Finally, a significant proportion of the companies surveyed believe that government policies in 2021 had a negative impact on business operations. Most reported expecting changes and improvements in policy with the new administration. The event aimed to seek stronger partnerships between global companies and SMEs (SMEs) as win-win cooperation between global companies and domestic SMEs and shared growth of the corporate ecosystem emerge as major management strategies for sustainable growth in the post-COVID-19 era. The forum, sponsored by Qualcomm Korea YH for the second time since last year, was attended by many officials from South Korea and the U.S. government, including Minister of SMEs Kwon Chil-seung and Deputy Economic Counselor of the U.S. Embassy Seoul Michael Cavanaugh. Representatives from domestic and foreign companies gathered to discuss ways to strengthen collaboration between global companies and SMEs in high-tech fields and promote future cooperation opportunities between the two countries under the topic “Promoting SMEs for Industry Convergence & Diversification.” In his opening remarks, AMCHAM Chairman & CEO James Kim emphasized partnerships between global companies and Korean SMEs. “U.S. companies have long valued their partnerships with innovative SMEs. Having a strong network of clients, customers and suppliers within the local SME ecosystem is key to business success in Korea,” he said. “U.S. businesses, in turn, contribute investments, innovations and jobs that have helped Korean SMEs prosper and fueled the country’s economic growth.” He also added, “This is a vision all leading Korean presidential candidates share ahead of the upcoming presidential election in March. With the right commitment and policy support from the Korean government, I am convinced that there is no limit to what such partnerships can achieve.” O.H. Kwon, SVP and President of Qualcomm APAC, also delivered welcoming remarks. “Qualcomm is hoping to accelerate the revitalization of the 5G ecosystem by joining with the excellent products and technologies of domestic SMEs,” he said. “Following mobile, automotive technology is emerging as the next-generation innovative industry, so we will continue to strengthen our collaboration with domestic SMEs so that these innovative technologies materialize into products and services.” He also added, “The government's continued interest and support are important to maintain win-win relationships in the future and promote cooperation with domestic small and medium-sized business partners.” H.E. Representatives from global companies such as Qualcomm Korea, GM Korea and 7 Korean companies presented on each company’s partnerships in the field, including best practices and future outlook.
