EVENT DESCRIPTION
The Serious Accidents Punishment Act (the “SAPA”), passed by the National Assembly on January 8, 2021, is intended to prevent serious workplace accidents and man-made disasters. It requires businesses (and government entities) to adopt health and safety management systems to prevent such accidents and imposes heavy criminal and administrative liability on companies and their senior officers if failure to do so results in serious accidents. SAPA can be seen as a legislative effort by the Korean government to address public concerns about numerous fatal industrial accidents and public disasters in recent years. SAPA provides broad outlines for a new system of criminal liability for workplace injuries and public disasters. Kim and Chang’s Webinar will highlight key features of the newly enacted law and suggest ways to mitigate potential risks.

About the Speaker

Jay J. Kim, Foreign Attorney (Admitted in New York), Kim & Chang

His work has included some of the leading patent and product liability cases litigated in Korea, involving blockbuster drugs, polymers, petrochemicals, consumer products, automobiles, vaccines and infant formula additives.
His IP practice also covers prosecution, disputes, transactions and criminal matters.
He also has extensive experience in environmental litigations, pharmaceutical and chemical regulatory issues, government relations and licensing negotiations.

Sung Min Won, Foreign Attorney, Kim & Chang

Sung Min Won is a Foreign attorney of Kim & Chang, with areas of expertise in health, labor & employment, and environment.
Sung Min received his J.D. from the Pepperdine University School of Law in 1994 and started his professional career as an international procurements officer at the Ministry of National Defense of Korea from 2000 to 2003.
After expanding his career at Lee & Ko (2003-2005), Sung Min served as a senior corporate at McDonald’s Korea from 2005 to 2018 before joining Kim & Chang as a foreign attorney.
